Renewing your Status as a Worker
Renewing your status as a worker means extending your current work permit so you can keep working in Canada beyond the expiration of your original permit. This process is crucial to avoid any interruptions in your legal employment status. Depending on the type of work permit you possess, It is possible to renew or extend your status as a worker either by acquiring a new offer of employment, or meeting one of the criteria for obtaining an Open Work Permit. In most cases, your eligibility for a work permit will fall under either the Temporary Foreign Worker Program (conditional work permits), or the International Mobility Program (open work permits).
Understanding the Process
A work permit allows you to work legally in Canada. Renewing your work permit before it expires is crucial to maintain your legal status and continue your employment without interruption.
When to Apply
- Apply Early: It is recommended to apply for renewal at least 30 days before your current work permit expires. You can apply as early as 90 days before expiration.
- Implied Status: If you apply before your work permit expires, you can continue to work in Canada under the same conditions until a decision is made on your renewal application.
Eligibility Requirements
To renew your work permit, you must:
- Have a valid job offer from a Canadian employer.
- Obtain a new Labour Market Impact Assessment (LMIA) from your employer, unless your job is LMIA-exempt.
- Meet the job’s specific requirements, such as education or work experience.
- Prove that you will leave Canada when your work permit expires unless you apply for a renewal.
